1. Who we are

These terms govern the purchase of services and products from Racquets Club Marbella S.L. (the "Club"), trading as Manolo Santana Racquets Club. Tax ID B85864528. Address: Ctra. de Istán, km 2, 29602 Marbella (Málaga), Spain. Registered in the Madrid Commercial Registry, volume 27,380, folio 58, section 8, sheet M-493437.

2. How to purchase

  1. You can purchase at the Club's reception, on our websites, by payment link or through the platforms we indicate. If you purchase through a third-party platform, its terms also apply.
  2. Before paying you will see the service, the final price including VAT, the validity and these terms, which you can save and print. Online, you can correct your details before confirming. The contract can be concluded in Spanish or English.
  3. By paying you accept these terms, and we will send you a confirmation by email or through the channel used. The Club keeps a record of your purchase, which you may request.
  4. Purchases for minors are made by their parent or guardian.
  5. If a product page contains specific conditions, they apply together with these terms and prevail where they differ.

3. General rule: final purchases and exchange

  1. Final purchases. Once purchased, amounts paid are not refunded because of a change of mind, absence, non-use of the service or personal preference, without prejudice to the legal rights in sections 8, 9, 10 and 11.
  2. Exchange. The amount paid and not used may be exchanged, at your request, for any other service or product of the Club. It is credited to your Club Wallet (Bono Monedero). Request it at reception or by email.
  3. Value of the exchange. The exchange starts from the amount actually paid, not the nominal value of the pack. What you have already used is deducted from that amount, at the prices set and published by the Club for those services on the purchase date, without the pack, bundle or period discount, which is linked to completing it. The balance will never be negative: you will not be charged any difference. We will send you the calculation in writing before crediting it.
  4. Validity and transfer. Exchanged credit is valid for 12 months from the date it is credited and cannot be refunded in cash, except as provided in sections 9, 10 and 11. At the holder's written request, it can be transferred to another person free of charge; the transfer does not extend its validity.
  5. Amount of a refund. Where money is to be refunded, the corresponding part of the amount actually paid is returned, calculated as for an exchange, using the same payment method. If the refund is due to the Club's failure to perform (section 10) or the legal right of withdrawal (section 11), it is calculated as those sections state, without applying the deduction in section 3.3.
  6. Exceptions. The Club's Management may authorise a refund on a one-off basis in view of the circumstances of the case, without this creating a right or a rule for other cases.

4. Private lessons and lesson packs

  1. Validity. Each pack expires within the period shown on its page, counted from the purchase. Credit not used on expiry is lost, unless the Club extends the period or section 10 applies.
  2. Duration. Each lesson lasts 50-55 minutes, depending on its type, within the booked slot.
  3. Student's lateness. The lesson ends at the scheduled time and the time lost is not recovered.
  4. Club's lateness. If a lesson starts late because of the Club, we will recover that time in the same lesson if possible, or make it up in another lesson. If the delay exceeds 15 minutes, you may also choose a free lesson. This compensation addresses the incident itself; a one-off incident does not in itself entitle you to a refund of the rest of the pack. Your legal rights under section 10 remain.
  5. Pack discount. The discounted price is linked to purchasing the number of lessons in the pack. If the Club voluntarily agrees to refund or exchange part of a pack already started, the lessons taken are charged at the individual rate in force on the purchase date. This rule does not apply to the legal right of withdrawal (section 11) or to refunds for the Club's failure to perform (section 10).
  6. Coach. The Club may replace the coach with another qualified one when necessary and will try to tell you in advance. If the change does not suit you, you may move the lesson at no cost.

5. Court and lesson bookings: cancellation

  1. Changing a day or time is the same as cancelling and booking again.
  2. 24 hours or more in advance: no charge. If you paid with a pack, the credit returns to the pack; otherwise, the amount goes to your Club Wallet.
  3. Less than 24 hours or no-show: the full amount is charged, as the Club has not had time to offer that court or slot to someone else. If the Club manages to fill the slot, it may consider an exception.
  4. If the Club cancels: you are not charged. We will offer you another time or the amount in your Club Wallet, and section 10 applies.

6. Rain and court conditions

  1. If an outdoor court cannot be used because of rain, the booking is cancelled at no cost and the amount goes to your Club Wallet. This does not apply to covered courts that remain available.
  2. Lessons affected by rain are made up on an agreed date or, in the school, under section 8.

7. Camps

  1. A place is confirmed on payment. If cash payment is offered, the period shown at registration applies; after that, the registration is cancelled automatically.
  2. A camp is a leisure activity with specific dates. For that reason there is no right of withdrawal, even if purchased online (Art. 103.l of the Spanish Consumer Act), and cancellation by the customer gives no right to a refund.
  3. The amount for days not attended may be exchanged under section 3. In case of illness with a medical certificate, the exchange is for the full amount of the days not yet started.
  4. If the Club cancels the camp or a week of it, it will refund the amount for what was not provided or, if you prefer, offer you another date.

8. Tennis and padel school

  1. Registration and fees are also governed by the published conditions of each course and group.
  2. Lessons not given because of the Club or rain are made up according to the course calendar and rules. A student's absences give no right to a make-up lesson or discount, unless the course states otherwise.
  3. Cancelling if you pay monthly. You can cancel by the same means used to register, or at reception, giving 15 days' notice before the next payment period. You will not be charged for the period after cancellation.
  4. Cancelling a term or bundle paid in advance. You can cancel at any time, by the same means used to register or at reception. For each month already started on the cancellation date, the full price of the single month that applies to you, under the rates published on the purchase date, is deducted from the amount paid, because the term or bundle discount is linked to completing it. The difference is credited to your Club Wallet (Bono Monedero), and you can exchange it for any service or product of the Club or transfer it to another person (section 3). If the months deducted exceed the amount paid, there is no balance and you will not be charged anything further. Example: a term costing €149, a single month costing €59, cancelling during the first month: 149 − 59 = €90 of credit.
  5. Section 8.4 does not apply if you exercise the legal right of withdrawal (section 11), where applicable, or if you cancel because of the Club's failure to perform (section 10).

9. Memberships

This section applies to memberships. The school is governed by section 8.

  1. Types. The types, prices, joining fee and services are those published from time to time on the memberships page; those in force at purchase apply to your contracted period.
  2. Monthly payment with minimum term. In this option the commitment is 6 months. If you cancel earlier, the penalty is proportional to the days remaining, and you will be told the amount before it is applied.
  3. Cancellation. You can cancel by the same means used to purchase, or at reception, with no other requirement. We will confirm the cancellation in writing.
  4. Memberships paid in advance. We will offer to exchange the unused part for services or products of the Club. If you do not want the exchange, that same part of the amount paid will be refunded. Time elapsed until your cancellation request counts as used, and is calculated at the monthly fee published for that membership type on the purchase date, if there is one; if not, in proportion to the time.
  5. Renewal. If your membership renews automatically, we will notify you at least 15 days before the deadline for saying you do not wish to renew.
  6. Freezing. Free for up to 182 days for non-residents, with proof of absence from the country. Request it at reception.
  7. Non-payment. If a fee is not paid, the Club may suspend the membership services until payment is made, after notifying you.

10. If the Club does not provide the service

  1. If the Club does not provide a contracted service, or provides it with a significant defect, for a reason attributable to it, you may choose between making it up on another date or with another coach, or receiving its amount in your Club Wallet.
  2. If these options do not suit you, or if the serious incident is repeated, the Club will refund the amount paid for what was not provided, using the same payment method. Sessions already taken are not refunded.
  3. Nothing in these terms limits the rights the law gives you in the event of non-performance.

11. Distance purchases: right of withdrawal

  1. When it applies. If you purchase without being physically present (by web, payment link sent remotely, telephone or messaging), you have 14 calendar days from the purchase to withdraw, without giving a reason.
  2. When it does not apply. There is no withdrawal for camps, lessons and bookings with a specific date or time (Art. 103.l), or for services already fully provided at your express request, as we will tell you before you pay. It also does not apply to purchases made in person.
  3. Packs and memberships. If you ask to start using them within the 14 days and then withdraw, the proportional part already provided, calculated on the total price paid, will be deducted.
  4. How to exercise it. Tell us clearly at manolosantanaclub@gmail.com or at reception before the period ends. You may use the model at the end of this document, but it is not compulsory.
  5. Refund. We will refund what is due using the same payment method, within 14 calendar days of your notice.

12. Complaints

  1. You can send any complaint to manolosantanaclub@gmail.com, by telephone on +34 952 77 85 80, to our postal address or at reception. We will give you proof of receipt and reply in writing within 15 days at most.
  2. Official complaint forms of the Junta de Andalucía are available at reception. If you purchased remotely, you can ask us to send you one.
  3. Official complaint forms are answered within 10 working days at most.
  4. You can contact the Municipal Consumer Information Office (OMIC) of your town or the consumer services of the Junta de Andalucía.

13. Data protection

Your data is processed in accordance with our Privacy Policy.

14. Changes to these terms

The Club may update these terms for the future. Each purchase is governed by the version in force on its date. For renewable services, relevant changes will be notified before renewal.

15. Applicable law

These terms are governed by Spanish law, and your rights as a consumer are not limited by them. In the event of a dispute, the competent court is the one determined by law, without prejudice to your right to go to the court of your place of residence.
